We will clear up this confusion as best we can below.<\/p>\n<p>Customers.ai\u2019s X-Ray tool is compliant with the CAN-SPAM Act of 2003.<\/p>\n<p>Customers.ai\u2019s X-Ray tool is compliant with the European Union\u2019s General Data Protection Regulation. This can be:<\/p><ul><li>Current street address<\/li><li>A P.O. box you\u2019ve registered with the United States Postal Service<\/li><li>A private mailbox you\u2019ve registered with a commercial mail receiving agency under Postal Service regulations.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-60e81f8 elementor-widget elementor-widget-heading\" data-id=\"60e81f8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Tell recipients how to opt out of receiving future emails from you.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba41004 elementor-widget elementor-widget-text-editor\" data-id=\"ba41004\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A business&#8217;s message must include:<\/p><ul><li>A clear and conspicuous explanation of how the recipient can opt out of getting email from you in the future. This notice must be easy for an ordinary person to recognize, read, and understand.<\/li><li>Give a return email address or another easy internet-based way to allow people to communicate their decision to opt out to you.<\/li><\/ul><p>You may give recipients an option to only opt out of certain emails from you but you must <b>always<\/b> include an option to opt out of <b>all<\/b> emails. Customers.ai does not allow senders to remove opt-out links from email communications.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8eecb25 elementor-widget elementor-widget-heading\" data-id=\"8eecb25\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Honor opt-out requests promptly.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef0570f elementor-widget elementor-widget-text-editor\" data-id=\"ef0570f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No matter how you choose to accept opt-out requests, the option must be able to process opt-out requests for at least 30 days after the email is sent.<\/p><p>You must honor the opt-out request within 10 business days of receiving. If you are sending emails via Customers.ai\u2019s system, this will be done automatically.<\/p><p>You cannot charge a fee as a condition of honoring the opt-out request.<\/p><p>You cannot require the recipient to give you any personally identifying information other than their email address as a condition of honoring the opt-out request.<\/p><p>You cannot make the recipient take any step other than sending a reply or visiting a single page on an Internet website as a condition of honoring the opt-out request.<\/p><p>Once someone has sent you an opt-out request, you cannot sell or transfer their email address. The only exception is that you may transfer the email addresses of people who have opted out to a company you\u2019ve hired to help you comply with the CAN-SPAM Act.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-42cdab8 elementor-widget elementor-widget-heading\" data-id=\"42cdab8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Monitor what others are doing on your behalf.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-24c9c85 elementor-widget elementor-widget-text-editor\" data-id=\"24c9c85\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Even if you hire another company to do your email marketing, you are still responsible for complying with the CAN-SPAM Act. Both you and the company hired are legally responsible.<\/p><p>If you do these things, you will be compliant with the CAN-SPAM act. If you do not, you may be in violation. Each separate email in violation of the CAN-SPAM Act is subject to penalties up to $50,120.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9ac5db6 elementor-widget elementor-widget-heading\" data-id=\"9ac5db6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">There is not an opt-in requirement in the CAN-SPAM Act.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-608adb1 elementor-widget elementor-widget-text-editor\" data-id=\"608adb1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>You are not required by the CAN-SPAM Act to attain an opt-in before sending someone a commercial email.
